Terms of Service

A subscription to AdjusterOS Pro grants you a personal, non-exclusive, non-transferable license to access and use the platform during the subscription period you have paid for. This license is for your individual professional use as an independent adjuster or claims professional. It does not transfer to another person and cannot be resold or sublicensed.

The platform is provided as software-as-a-service. You access it over the internet; we maintain the infrastructure. You do not receive a copy of the software itself and acquire no ownership interest in the platform or any of its components.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your credentials have been compromised, notify us immediately at support@agentiqly.io.

You may not share account access with another person. Each individual who uses the platform requires their own subscription. If we detect that a single account is being used by multiple people, we may suspend the account pending resolution.

You must provide accurate information when you register and keep it current. Accounts created with false information may be terminated without refund.

You may use AdjusterOS Pro for lawful professional purposes in connection with property and casualty claims adjustment. The following uses are specifically prohibited:

• Using the platform to process claims or perform adjusting work in any jurisdiction where you do not hold the required license
• Submitting false, fraudulent, or misleading claims information through the platform
• Attempting to probe, scan, or test the security of the platform or its underlying infrastructure
• Reverse engineering, decompiling, or attempting to extract source code from the platform
• Using automated scripts or bots to access the platform outside of the documented API, if any
• Reselling, sublicensing, or otherwise commercializing access to the platform for third parties
• Using the platform to build a competing product or to benchmark it for a competing product without our prior written consent
• Uploading content that infringes the intellectual property rights of any person

We reserve the right to suspend or terminate any account that we reasonably believe is engaged in prohibited use, with or without prior notice depending on the severity of the conduct.

You own your data. The claims records, client files, documents, photos, and correspondence you create in AdjusterOS Pro remain yours. We process them only to operate the platform on your behalf.

By using the platform, you grant AgentiQly.io a limited license to store, process, and transmit your data solely as necessary to provide the service. This license ends when your data is deleted from our systems following account closure.

You are responsible for ensuring that any personal data you enter — including your clients' names, contact information, and claim details — is handled in compliance with applicable privacy laws and your professional obligations as an adjuster.

New accounts begin with a 30-day trial charged at $7. A payment method is required to start the trial. At the end of the trial your subscription converts automatically to the plan you selected at the then-current rate, unless you cancel before the trial ends. We will remind you by email before that happens.

Subscriptions after the trial are billed monthly in advance. Prices are stated at checkout and are subject to change. We will notify you by email at least thirty days before any price change takes effect on your renewal date, and you will have the option to cancel before the new price applies.

Where a subscription is described as a founding or locked rate, that rate applies for as long as the subscription remains continuously active. Cancelling and later resubscribing does not restore a discontinued rate.

Payments are processed by Stripe. By subscribing, you authorize us to charge the payment method on file for each renewal period. If a payment fails, we will notify you and provide a grace period to update your payment information before access is suspended.

You may cancel your subscription at any time through the billing settings in the platform or by contacting support@agentiqly.io. Cancellation takes effect at the end of your current billing period. We do not prorate or refund the unused portion of a prepaid subscription period, except as required by applicable consumer protection law.

If you cancel within seven days of your initial subscription purchase and have not yet opened more than five claims on the account, contact us and we will issue a full refund, no questions asked.

Each plan includes a daily allowance of AI-assisted generations and Peer Partner exchanges, and a storage allowance for the photos, documents, and other evidence you upload. The allowances that apply to your plan are shown on the pricing page and in your account settings. They are set well above what normal professional use requires.

• Solo — 50 AI generations and 25 Peer Partner exchanges per day, 100 GB of storage
• Pro — 200 AI generations and 100 Peer Partner exchanges per day, 500 GB of storage
• BYOK — you supply your own inference API key and are billed for that usage directly by your provider, 100 GB of storage
• Trial — 15 AI generations and 10 Peer Partner exchanges per day, 25 GB of storage

Storage above your plan allowance is billed at $0.10 per gigabyte per month. We will notify you before billing any overage and give you the opportunity to remove data or change plans instead.

We reserve the right to rate-limit, throttle, or suspend an account whose usage is materially disproportionate to normal professional use, places an unreasonable load on the platform, or appears to be automated, resold, or shared. Where circumstances allow we will contact you and try to find a workable arrangement before taking any action.

When a subscription ends — whether you cancel, the trial expires without conversion, or the account is terminated — your data remains available for export for thirty days. During that window you can sign in and download your claims, documents, photos, and correspondence.

After thirty days we permanently delete the account's data from our production systems. Deletion is irreversible. Residual copies may persist in encrypted backups for a limited period, after which they expire on the ordinary backup rotation.

If you need your records preserved beyond thirty days — for litigation, arbitration, or a regulatory obligation — contact support@agentiqly.io before the window closes and we will make arrangements. We would rather hold your evidence than have you lose it.

AgentiQly.io owns all rights in the AdjusterOS Pro platform, including its codebase, design, AI features, automation logic, and any improvements or derivatives thereof. Nothing in these terms transfers any intellectual property rights to you.

If you provide feedback, feature suggestions, or other input about the platform, you grant us permission to use that input without restriction and without compensation to you. We are not obligated to act on feedback, but we read it.

To the maximum extent permitted by applicable law, AgentiQly.io's total liability to you for any claims arising from your use of AdjusterOS Pro — whether in contract, tort, or any other theory — is limited to the fees you paid for the subscription in the twelve months preceding the event giving rise to the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

The platform is a professional tool that assists you in your work. It does not replace your professional judgment, your licensing obligations, or your duty to your clients and the parties you serve. Decisions made using information generated by the platform remain yours and yours alone.

The platform is provided "as is" and "as available." We make commercially reasonable efforts to maintain uptime and data integrity, but we do not warrant that the platform will be error-free, uninterrupted, or free of security vulnerabilities.

We do not warrant that outputs from AI-assisted features — letters, summaries, analysis, or suggestions — are accurate, complete, or suitable for any particular purpose. All AI-generated content must be reviewed and approved by you before use.

To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

If you have a dispute with us, contact support@agentiqly.io first. We will make a good-faith effort to resolve it within fifteen business days. Most disputes that reach us this way get resolved without further escalation.

If direct resolution fails, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English. Class action and jury trial rights are waived. You may opt out of arbitration within thirty days of your initial registration by sending written notice to support@agentiqly.io; if you opt out, disputes will be resolved in the courts of competent jurisdiction in the state where AgentiQly.io is registered.

These terms are governed by applicable law. If any provision is found unenforceable, the remainder of the terms continue in effect. Our failure to enforce any provision does not waive our right to enforce it later.

We may update these terms from time to time. If we make a material change, we will notify you by email at least fourteen days in advance. Continued use of the platform after the effective date of updated terms constitutes acceptance.

These terms, together with our Privacy Policy and Licensing & Disclosures page, constitute the entire agreement between you and AgentiQly.io regarding your use of AdjusterOS Pro.
